Abstract
Water is one of the greatest blessings bestowed by God (Glory be to Him) upon His creatures. It is a vital and essential element in the environment that plays a crucial role in various aspects of life. The current problem of water scarcity has caused numerous damages in all aspects of life in Iraq due to various internal and external factors contributing to water scarcity.
The right to provide safe drinking water and daily use imposes an obligation on the executive authority represented by the Ministry of Water Resources and its affiliated bodies to protect water resources from encroachment or pollution through legal means and measures granted by law, whether these means are preventive or remedial, and whether they precede or follow the occurrence of harm.
Furthermore, water regulatory bodies are obliged to compensate individuals for damages resulting from their actions based on administrative liability. Individuals have the right to claim compensation if there is concrete and direct harm proven to have resulted from the administration's performance of its duties and responsibilities.
